Privacy Policy

This Policy describes how we collect, use, store, share, and protect information in connection with AccessibilityTracker, including all features, tools, services, and functionality provided through the Platform.

Introduction

AccessibilityTracker.com ("AccessibilityTracker," "Tracker," or the "Platform") is owned and operated by Accessible.org, LLC, a Texas limited liability company ("Accessible.org," "we," "us," or "our"). AccessibilityTracker is a property of Accessible.org and is subject to the governance, policies, and practices of Accessible.org.

This Privacy Policy ("Policy") describes how we collect, use, store, share, and protect information in connection with AccessibilityTracker, including all features, tools, services, and functionality provided through the Platform. "You" refers to any individual or entity that accesses, uses, or interacts with the Platform.

By accessing or using AccessibilityTracker, you acknowledge that you have read, understood, and agree to the practices described in this Policy. If you do not agree with this Policy, you must immediately discontinue use of the Platform. This Policy is incorporated into and subject to our Terms and Conditions. In the event of a conflict, the Terms and Conditions shall control.

Accessible.org reserves the right to update or modify this Policy at any time without prior notice. Changes become effective upon posting to AccessibilityTracker or accessible.org. Your continued use of the Platform following modifications constitutes acceptance of the revised Policy. It is your responsibility to review this Policy periodically.


Nature of the Platform and Data Practices

AccessibilityTracker is a compliance management platform designed to help organizations track, manage, and monitor digital accessibility issues across their web properties. The Platform enables users to log accessibility issues, assign remediation tasks, monitor progress, run automated scans, and generate reports related to WCAG conformance and accessibility compliance.

It is important to understand the nature of the data handled within the Platform. AccessibilityTracker processes technical, accessibility-related information, including but not limited to: website URLs and page inventories, accessibility issue descriptions and WCAG success criteria evaluations, issue severity and priority classifications, remediation status and assignment data, automated scan results, screenshots and page-level technical data, and compliance tracking metrics.

The Platform is not designed to collect, store, or process end-user personal information, customer databases, protected health information, financial records, authentication credentials, trade secrets, or other categories of sensitive personal data belonging to you or your end users. If you inadvertently submit sensitive data to the Platform outside the scope of accessibility tracking, you are responsible for removing such data or notifying us promptly so we can assist with its removal. The data stored within AccessibilityTracker pertains to the technical accessibility status of digital properties, not to the personal data of the individuals who visit those properties.


Information We Collect

Account Information

When you create an account on AccessibilityTracker, we collect information necessary to establish and manage your account, including but not limited to: name, email address, company or organization name, password (stored in hashed form), and account preferences and settings. If your account is part of an organization with multiple users, your account administrator may have access to certain account-level information and usage data associated with your organization's account.

Information You Submit to the Platform

In the course of using AccessibilityTracker, you may submit or generate information within the Platform, including but not limited to: website URLs and digital property identifiers, accessibility issues and associated descriptions, screenshots and annotations, remediation notes, assignments, and status updates, project and property configurations, scan configurations and scheduling preferences, and reports generated through the Platform. You are solely responsible for the information you submit to the Platform and for ensuring that such information does not include sensitive personal data unrelated to accessibility tracking.

Payment and Subscription Information

Payments for AccessibilityTracker subscriptions and add-on services are processed through third-party payment processors including but not limited to Stripe. Accessible.org does not directly store your full credit card number, bank account information, or other sensitive financial data. Payment processors handle your financial information in accordance with their own privacy policies and applicable data security standards including PCI-DSS. We retain records of your subscription tier, billing history, and transaction amounts for accounting and service management purposes.

Information Collected Automatically

When you access AccessibilityTracker, certain information is collected automatically, including but not limited to: anonymized IP addresses, approximate geographic location (country, region, or city), browser type and version, device type and operating system, pages and features accessed within the Platform, session duration and usage patterns, and referring URL or source. This information is used to maintain, improve, and secure the Platform and to understand usage patterns.

Automated Scan Data

If you use AccessibilityTracker's scanning and monitoring features, the Platform will access your designated web properties to perform automated accessibility evaluations. This scanning process collects publicly available information from the target URLs, including page structure, HTML source code, rendered page content, and related technical data necessary to evaluate accessibility conformance. The scan does not access password-protected areas, backend systems, databases, or any data not publicly available on the scanned pages unless you explicitly provide authenticated access, in which case the scope of access is limited to what is necessary to perform the accessibility evaluation.


How We Use Your Information

We use collected information for the following purposes: to provide, maintain, operate, and improve the Platform and its features; to process account registration, authentication, and management; to process subscriptions, invoices, and payments; to perform automated accessibility scans and generate scan results; to enable issue tracking, assignment, remediation management, and reporting within the Platform; to communicate with you about your account, subscription, and Platform-related matters; to analyze usage trends and improve the functionality, performance, and user experience of the Platform; to detect, prevent, and address technical issues, security threats, and abuse; to comply with legal obligations, enforce our Terms and Conditions, and protect the rights, property, and safety of Accessible.org, our users, and the public; and to send service-related communications necessary for the operation of your account.

We do not sell, rent, or lease your personal information or your Platform data to third parties. We do not use your information for behavioral advertising or ad targeting. We do not use Platform data submitted by one client to benefit another client.


Use of Artificial Intelligence

Accessible.org may use artificial intelligence ("AI") tools and technologies, including third-party AI services, in connection with certain features and operations of the Platform. This may include but is not limited to: analyzing scan results and generating accessibility issue descriptions or remediation recommendations, processing and categorizing accessibility issues, generating reports and compliance summaries, and supporting internal development and improvement of Platform features.

As described in the "Nature of the Platform and Data Practices" section above, the data processed through AI tools in connection with the Platform is limited to technical, accessibility-related information such as page structure, source code, accessibility issue descriptions, WCAG evaluations, scan results, and remediation recommendations. We do not process end-user personal information, customer databases, protected health information, financial records, authentication credentials, or other categories of sensitive personal data through AI tools.

When Platform data is submitted to third-party AI service providers, that data is processed in accordance with the applicable AI provider's terms of service and privacy policy, not this Policy. Accessible.org selects AI service providers whose terms prohibit the use of input data for model training and whose data handling practices are consistent with our confidentiality obligations, but Accessible.org does not control and cannot guarantee the data practices of third-party AI providers. Accessible.org does not use your Platform data to train, fine-tune, or improve any AI models, whether proprietary or third-party.

AI-assisted outputs generated within the Platform are provided for informational and technical guidance purposes only and do not constitute a guarantee of accuracy, completeness, legal compliance, or conformance with any accessibility standard. You are responsible for reviewing and validating any AI-generated content before relying on it.


How We Share Your Information

Accessible.org does not sell your personal information or your Platform data. We may share information in the following limited circumstances.

Service Providers and Contractors

We engage contractors and service providers who perform functions on our behalf, including but not limited to software development, infrastructure management, and technical support. All contractors and service providers who may access Platform data or user information are bound by written confidentiality obligations at least as protective as those described in this Policy and our client Services Agreements. Contractors and service providers are permitted to access only the information necessary to perform their assigned duties and are prohibited from using such information for any other purpose.

Infrastructure and Hosting Providers

The Platform is hosted on third-party infrastructure providers. These providers may have access to data stored on the Platform as part of their hosting services but are contractually prohibited from accessing, using, or disclosing such data except as necessary to provide the hosting services.

Payment Processors

We share billing and subscription information with third-party payment processors (including Stripe) solely for the purpose of processing transactions. These processors handle your financial data under their own privacy policies and security standards.

Legal Requirements

We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Accessible.org, our users, or the public, or to enforce our Terms and Conditions.

Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of Accessible.org's assets, your information and Platform data may be transferred as part of that transaction. We will provide notice before your information becomes subject to a different privacy policy.

We do not share, disclose, or transfer your Platform data (including accessibility issues, scan results, audit reports, remediation findings, website URLs, and related technical information) to any third party except as described above, as required by law, or with your prior written consent.


Data Ownership and Portability

You retain ownership of the data you submit to AccessibilityTracker, including accessibility issues, project configurations, and other content you create within the Platform. Accessible.org retains ownership of the Platform itself, including all software, algorithms, tools, templates, interfaces, and proprietary methodologies.

You may request an export of your Platform data at any time by contacting us at the address provided below. We will provide your data in a reasonable, commonly used format within a reasonable timeframe.

Upon termination of your account or subscription, your Platform data will be retained for a period of thirty (30) days to allow you to request an export. After this period, your data will be deleted from our active systems, though it may persist in backups for a limited period consistent with our backup retention schedule before being permanently removed.


Data Retention

We retain information for as long as necessary to fulfill the purposes described in this Policy, to comply with legal obligations, to resolve disputes, and to enforce our agreements. Specifically: account information is retained for the duration of your account and for a reasonable period thereafter to fulfill legal and business obligations; Platform data including accessibility issues, scan results, and project information is retained for the duration of your account and subject to the termination provisions described above; payment and subscription records are retained as required by applicable tax and accounting laws; and automatically collected usage data is retained in anonymized form for analytics and Platform improvement purposes.

You may request deletion of your personal information or Platform data at any time by contacting us at the address provided below, subject to our obligation to retain certain data for legal, accounting, or security purposes.


Data Security

We implement reasonable administrative, technical, and organizational measures designed to protect the confidentiality, integrity, and availability of your information and Platform data. These measures include but are not limited to: use of encrypted communications (HTTPS/TLS) across the Platform; encryption of sensitive data at rest; access controls limiting data access to authorized personnel and contractors on a need-to-know basis; hashed password storage; written confidentiality agreements with all contractors and service providers who access Platform data; secure payment processing through PCI-DSS-compliant third-party processors; regular review of security practices, access permissions, and infrastructure configurations; and monitoring for unauthorized access and anomalous activity.

Given the technical nature of the data stored within the Platform (accessibility issue descriptions, WCAG evaluations, scan results, page URLs, and similar technical information rather than sensitive personal data or customer records), the risk profile associated with Platform data is inherently limited. Nonetheless, we maintain security practices appropriate to the nature and sensitivity of all information in our possession.

No method of transmission over the internet or method of electronic storage is completely secure. While we strive to protect your information, Accessible.org cannot guarantee absolute security and assumes no liability for any unauthorized access, disclosure, alteration, or destruction of information resulting from circumstances beyond our reasonable control.


Your Rights

Depending on your jurisdiction, you may have certain rights regarding your personal information, which may include the right to: access the personal information we hold about you; request correction of inaccurate or incomplete information; request deletion of your personal information and Platform data, subject to legal and contractual retention requirements; request an exported copy of your Platform data; object to or restrict certain processing of your information; and withdraw consent where processing is based on consent.

For California Residents

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected, the right to request deletion of your personal information, and the right to opt out of the sale of personal information. Accessible.org does not sell personal information. To exercise your rights under the CCPA, please contact us at the address below.

For Users Outside the United States

If you are located outside the United States, including in the European Economic Area, United Kingdom, or other jurisdictions with data protection laws, please be aware that your information and Platform data may be transferred to, stored, and processed in the United States where our servers and operations are located. By using the Platform, you consent to the transfer of your information to the United States, which may not provide the same level of data protection as your jurisdiction. If you are located in the EEA or UK and believe you have rights under the General Data Protection Regulation (GDPR) or UK GDPR, please contact us to discuss how we can address your request. Our lawful bases for processing include performance of a contract, legitimate interests, and consent where applicable.

To exercise any of these rights, please contact us at info@accessible.org. We will respond to your request within a reasonable timeframe and in accordance with applicable law. We may require verification of your identity before processing your request.


Additional Provisions

Children's Privacy

The Platform is not directed at individuals under the age of 16, and we do not knowingly collect personal information from children under 16. If we become aware that we have inadvertently collected personal information from a child under 16, we will take reasonable steps to delete such information promptly. If you believe we have collected information from a child under 16, please contact us immediately at the address below.

Third-Party Websites and Services

The Platform may contain links to third-party websites, services, or resources that are not operated by Accessible.org. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. Your interactions with third-party websites are governed solely by those third parties' privacy policies.

Do Not Track Signals

The Platform does not currently respond to "Do Not Track" browser signals.

Limitation of Liability

To the fullest extent permitted by applicable law, Accessible.org shall not be liable for any unauthorized access to, disclosure of, alteration of, or destruction of your personal information or Platform data, except to the extent caused by Accessible.org's gross negligence or willful misconduct. In no event shall Accessible.org's total liability arising out of or related to this Policy exceed the greater of one hundred dollars ($100.00) or the total amount paid by you to Accessible.org for Platform subscriptions in the twelve (12) months preceding the event giving rise to liability. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise.

Governing Law

This Policy shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to this Policy shall be resolved in accordance with the Dispute Resolution provisions of our Terms and Conditions.
